Buying property in the Kurdistan Region is generally straightforward, but a few legal checks separate a smooth deal from a costly mistake.
Property prices in Erbil and Sulaymaniyah have risen steadily over recent years, attracting both local and diaspora buyers. Before signing anything, run through this checklist.
Title verification
- Obtain the official title deed (Tapu) and confirm it matches the seller's identity.
- Check the property at the Real Estate Registration Directorate for any mortgage, lien, or restriction.
- Confirm there are no pending court cases attached to the property.
Permits and zoning
- For undeveloped land, verify that the construction permit can actually be issued for your intended use.
- For apartments, check that the building has its final completion certificate.
- For commercial properties, confirm zoning allows your planned activity.
Payment and registration
- Use bank transfers, not cash, to create a clear paper trail.
- The transfer must be registered at the Real Estate Registration Directorate to be enforceable against third parties.
- Foreign buyers may need additional documentation depending on the type of property.
Common pitfalls
- Trusting unregistered "intent to sell" papers as proof of ownership.
- Paying significant deposits before a notarised preliminary contract is in place.
- Assuming the developer's marketing materials reflect the actual building permit.
